Characteristics of the goods and services offered

The products and services offered are those listed in the catalogue published on the Buddha Farm's website.

Each product is accompanied by a description prepared by the supplier; for some of them, bearing the mention DF, the buyer can have access to the supplier's documentation.

The photographs in the catalogue are as accurate as possible but cannot guarantee a perfect likeness to the product offered, particularly with regard to colours.

Prices

The prices listed in the catalogue are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

Buddha Farm reserves the right to change its prices at any time, it being understood however that the price appearing on the catalogue on the day of the order will be the only one applicable to the buyer.

Promotional codes and coupons are applicable to all products except those currently on promotion and special offers.

The prices shown do not include order processing, transport and delivery charges, provided that delivery takes place within the geographical areas specified below.

Geographic area

The online sale of products and services presented on the site is reserved for buyers who reside in France, in the French Overseas Departments and Territories or in Europe and for deliveries required in these geographical areas.

Orders

The buyer, who wishes to purchase a product or service, must:

• fill out the identification form on which he will indicate all the requested details or give his customer number if he has one;
• fill out the online order form providing all the references for the products or services chosen;
• confirm your order after checking it;
• make the payment under the conditions stipulated;
• confirm your order and payment.

Order confirmation implies acceptance of these terms and conditions of sale, acknowledgment of having read and understood them, and a waiver of any right to invoke one's own terms of purchase or other conditions.

All data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will constitute acceptance of the transactions carried out. The seller will send an email confirming the contract offer.

Withdrawal

Except as otherwise provided by law, the consumer has a 14-day withdrawal period from the date of delivery of their order to inform the online retailer, in writing, of their intention to withdraw and to return the product to the seller at their own expense. Upon receipt of the withdrawal notice, the online retailer has 14 days to reimburse the consumer for the price paid, excluding return shipping costs.

Payment methods

Payment is due upon ordering.

Payments will be made by credit card; they will be made through the secure Paygreen system which uses the SSL (Secure Socket Layer) protocol so that the information transmitted is encrypted by software and no third party can access it during transport over the network.

The buyer's account will only be debited upon shipment of the products or services, and only for the amount of the products or services shipped or downloaded. Upon request, the buyer will receive a paper invoice showing the VAT.

Deliveries

Deliveries are available from €50 and are made to the address indicated for purchase in the order form, which must be within the agreed geographical area.

The risks are borne by the buyer from the moment the products have been delivered.

In case of damage during transport, the buyer must make detailed reservations on the delivery slip, and contact the seller as soon as possible.

If delivery times exceed thirty days from the order date, the sales contract may be cancelled and the buyer refunded.

Guarantee

The purchase of any contractual guarantee does not preclude the application of the legal provisions relating to the legal guarantee of conformity, as set out in Articles L211-4 et seq. of the Consumer Code, and to the guarantee against hidden defects, as mentioned in Articles 1641 to 1648 of the Civil Code, reproduced below:

Article L211-4 of the Consumer Code 

The seller is required to deliver goods that conform to the contract and is liable for any defects in conformity existing at the time of delivery.

He is also liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter was his responsibility under the contract or was carried out under his supervision.

Article L211-5 of the Consumer Code 

To comply with the contract, the goods must:

1) Be fit for the purpose for which goods of the same type are normally used and, where applicable:

• To correspond to the description given by the seller and to possess the qualities that the seller presented to the buyer in the form of a sample or model;
• To present the qualities that a buyer can legitimately expect, given the public statements made by the seller, the producer or their representative, particularly in advertising or labeling;

2) Or present the characteristics defined by mutual agreement between the parties or be suitable for any special purpose sought by the buyer, made known to the seller and accepted by the latter.

Article L211-12 of the Consumer Code 

The action resulting from the lack of conformity is time-barred after 2 years from the delivery of the goods.

Article 1641 of the Civil Code 

The seller is bound by the warranty against hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them.

Article 1648, paragraph 1 of the Civil Code 

The action resulting from latent defects must be brought by the buyer within 2 years from the discovery of the defect.

In the event of a non-conformity of a sold product, it may be returned to the seller who will take it back, exchange it or refund it.

All claims, requests for exchange or refund must be made by post to the following address: 3 rue brûlée 57100 Thionville, within thirty days of delivery.

Responsibility

In the online sales process, the seller is bound by an obligation of result.

However, it cannot be held liable for any damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other unintentional problems.

Intellectual property

All elements of the Buddha Farm's website are and remain the exclusive intellectual property of Buddha Farm's. No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, any elements of the website, whether software, visual, or audio.

Any simple or hypertext link is strictly prohibited without the express written consent of Buddha Farm's.
